Terms of Service

1. Agreement to These Terms

These Terms of Service govern your access to and use of the TextRhino website, dashboard, browser extension, templates, snippets, commands, forms, synchronization features, documentation, support, and related services, collectively the "Services."

The Services are operated by AgentGYM Inc., United States, doing business as TextRhino. References to "TextRhino," "we," "us," and "our" mean AgentGYM Inc.

By accessing or using the Services, you agree to these Terms. If you use the Services on behalf of a company or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.

2. Eligibility and Accounts

You must be at least 13 years old to use TextRhino. Where applicable law requires consent from a parent, guardian, employer, school, or other authorized party, you are responsible for obtaining that consent before using the Services.

You are responsible for maintaining accurate account information, protecting your login credentials, and for all activity under your account.

You must promptly notify us at founder@textrhino.com if you believe your account has been compromised.

3. Your Content

TextRhino lets you create, store, edit, sync, and expand snippets, folders, templates, and command configurations. You retain ownership of content you submit to the Services.

Snippets and related workspace content are saved in Google Cloud™. Firebase™ may be used for authentication and related account services.

You grant TextRhino a limited license to host, store, process, transmit, display, and otherwise use your content only as needed to provide, secure, and maintain the Services.

You are responsible for ensuring that your snippets and templates do not contain unlawful content, malware, regulated data you are not permitted to process, or content that infringes someone else's rights.

4. Acceptable Use

You agree not to misuse TextRhino. For example, you may not:

• Use the Services for unlawful, harmful, deceptive, abusive, or fraudulent activity.
• Attempt to gain unauthorized access to TextRhino, another user account, or connected systems.
• Interfere with the security, integrity, performance, or availability of the Services.
• Reverse engineer, scrape, overload, or bypass rate limits except where allowed by law.
• Use TextRhino to send spam or generate content that violates third-party platform rules.

5. Browser Extension

The TextRhino browser extension runs in your browser to detect shortcuts and insert saved snippets into supported web pages. Browser behavior may vary depending on site restrictions, browser updates, permissions, and operating system settings.

You are responsible for reviewing snippets before inserting them into third-party websites or applications. TextRhino is not responsible for the content of third-party websites or how they process text you insert.

6. Service Availability

TextRhino features, limits, and service availability may change over time. Material changes will be communicated where required.

7. Third-Party Services

TextRhino relies on third-party services including Google Cloud™ for cloud infrastructure, Firebase™ for authentication, Vercel for hosting, and browser platform services for the Google Chrome™ extension. Your use of those services may also be subject to their terms and privacy policies.

8. Intellectual Property

The Services, including TextRhino's software, design, branding, documentation, and templates supplied by TextRhino, are owned by TextRhino or its licensors and are protected by intellectual property laws.

These Terms do not grant you rights to use TextRhino trademarks, logos, or branding except as necessary to identify the Services.

9. Service Changes and Availability

We may modify, suspend, or discontinue parts of the Services, including features, limits, and integrations. We will try to provide reasonable notice when a material change negatively affects users.

10. Termination

You may stop using TextRhino at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or misuse the Services.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, indemnity, and dispute provisions.

11. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, TextRhino disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

12. Limitation of Liability

To the fullest extent permitted by law, TextRhino will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or procurement of substitute services.

To the fullest extent permitted by law, TextRhino's total liability for any claim relating to the Services will not exceed the greater of the amount you paid to TextRhino in the three months before the claim or USD $100.

13. Indemnity

You agree to defend, indemnify, and hold TextRhino harmless from claims, damages, losses, liabilities, costs, and expenses arising from your content, your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

14. Governing Law and Disputes

These Terms are governed by the laws applicable in the United States, without regard to conflict of law rules. Subject to applicable law, courts located in the United States will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Services.

15. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice by posting the updated Terms on this page, emailing users, or using another reasonable method. Continued use after the effective date means you accept the updated Terms.
